Service Terms
Version 1 · November 1, 2026 · duggantech.com/terms/v1

These terms apply to every order with Duggan Technologies, LLC ("we", "us"). "You" means the business placing the order. Your order (the order summary we send you, or the checkout page you pay on) says what you're buying and what it costs. The order and these terms together are the whole agreement. If they disagree, the order wins.

1. Agreeing

You accept these terms by checking the box at checkout, paying for an order, signing it, or telling us you agree in writing (email or text counts). The person who accepts confirms they can agree on behalf of the business.

2. The work

  • We do the work described in your order. Anything else is quoted first and done only once you approve it (email or text counts).
  • We're an independent business, not your employee. We decide how the work gets done, and we may use contractors and software tools to do it.
  • When something needs your approval, like a website preview, we'll send it to you. If we don't hear back within 30 days, it counts as approved.

3. Your part

  • Give us the content, access and answers the work needs. Delays on your side push the schedule back.
  • You're responsible for everything you give us or ask us to publish: text, photos, logos, prices and claims about your business. You confirm you have the right to use it and that it's accurate and legal.
  • Accounts for your business (Google Business Profile, email, payment processors and the like) belong to you. We use access you give us only for your work.

4. Payment

  • Prices and due dates are in your order. Invoices are due within 14 days unless the order says otherwise.
  • Monthly plans are charged automatically until cancelled. We may change a monthly price with 30 days' notice by email.
  • Expenses you approve in advance (software, stock photos and the like bought for your work) are billed at cost.
  • Payments are non-refundable, except as section 5 or your order says.
  • If a payment is more than 14 days late, we may pause work. If it's more than 30 days late, we may suspend service, including taking a site offline. You also cover our reasonable costs of collecting unpaid amounts.

5. Cancelling

  • Monthly service is month to month unless your order sets a minimum term. Either of us can cancel with 30 days' notice by email.
  • If you cancel before a project is finished, what you've paid isn't refunded, and work completed up to that point is still owed.
  • We can also end service with 30 days' notice. If we do, and you didn't break these terms, we refund any prepaid fees for months we won't provide.

6. Ownership

  • Once your order is paid in full, you own what we made for you, such as your website's design, content and code. Your own materials stay yours.
  • We keep our own tools, templates, code libraries and know-how, and may reuse them. Where they're part of something we made for you, you get a permanent right to use them in it.
  • Tools we provide as part of a monthly plan (like a price estimator or quote form) end when that plan ends.
  • If we register a domain for your business, we'll transfer it to you whenever you ask, at no charge.
  • When service ends and you're paid up, we'll hand over your site files and domain on request and remove our access to your accounts.

7. No guarantees

Everything we provide is "as is" and "as available". We make no promises or warranties of any kind, stated or implied, including that anything will be fit for a particular purpose, error-free, secure or always available.

  • There is no service level agreement. We don't promise uptime, response times, support hours or how fast anything gets fixed. We'll do our best.
  • We don't promise search rankings, leads, calls, sales or any other business result.
  • Hosting providers, domain registrars, Google, payment processors, email services and other outside services can fail or change at any time. They're outside our control, and we're not responsible for them.
  • We don't promise that backups exist or can be restored. Keep your own copies of anything that matters to you.
  • Estimates of time or cost, and anything a price estimator shows your customers, are estimates, not promises.

8. Limit of liability

To the fullest extent the law allows, we are not liable to you for any loss or damage connected with our work or these terms, including lost profits, lost revenue, lost data, downtime, security breaches, business interruption, and indirect, incidental, special or consequential damages. This applies however the claim arises, including breach of contract, warranty, or our own negligence, and even if we were told the loss was possible.

If we're found liable anyway, the most we'll owe in total is the amount you paid us in the 30 days before the claim arose.

You'll cover us (including reasonable legal fees) for any claim by someone else arising from your content, your business, your use of what we made, or your breaking these terms.

9. Disputes

  • If something goes wrong, tell us in writing first and give us 30 days to sort it out.
  • These terms are governed by New Hampshire law. Any lawsuit goes to the state courts in Rockingham County, New Hampshire, including small claims.
  • Any claim against us must be brought within one year of when it arose.

10. General

  • Notices. Email counts as written notice: to us at [email protected], to you at the email on your order.
  • Portfolio. We may show work we did for you, your business name and general results as examples of our work, unless your order says otherwise.
  • Privacy. We keep your non-public business information private and use it only for your work.
  • Changes to these terms. New versions apply to new orders. For ongoing monthly service, we'll email you 30 days before a new version applies. Continuing the service after that means you accept it. Every version stays available at duggantech.com/terms.
  • Everything else. If part of these terms can't be enforced, the rest still applies, and that part applies as far as the law allows. Changes to an order must be in writing; email counts. Sections 6 to 9 continue after service ends.
